Towed from private property in Colorado: what to know

Finding an empty parking space where your car used to be is awful. In Colorado, tows from private property without the owner's consent, called nonconsensual tows, are regulated by the Public Utilities Commission. This site does not perform those tows, but here is where to start.

Find out who towed it

Look for tow signs posted at the lot entrance; they typically name the towing company. If you cannot find a sign, call the non-emergency number of the local police department to check whether it was towed or stolen.

Your situation depends on where it was towed from

The PUC's towing consumer page separates residential areas (apartments, condos, mobile home communities), commercial areas (stores, restaurants) and law enforcement tows, because the rules differ. Start there for the rules that apply to you.

Rate caps and release

The PUC sets maximum rates for many types of tows. For a nonconsensual tow from residential private property, the PUC's Towed Vehicle Release Form allows release of the vehicle upon paying 15 percent of the balance owed, not to exceed $60, with the rest due later, according to the PUC.

Think the tow was illegal?

The PUC's Consumer Affairs Unit takes towing complaints and can forward them for investigation. The PUC reports that from 2022 through 2024 it obtained 469 refunds for towing customers. Keep your receipts, photos of signs, and any paperwork from the tow company.

What to bring when you pick up the car

The PUC lists a Vehicle Release Form for Authorized Operators that documents proof of your connection to the vehicle, such as registration, insurance, the VIN and keys. Bring your ID, registration and proof of insurance, and check the car for damage before you leave the lot.

Check a tow company's permit

The PUC's transportation permit search lets you look up any towing carrier's permit status.
